Filby Driver Training - hereafter referred to as “FDT” LICENCE: On commencement of training, all trainees must be in possession of a current Full or Provisional Licence. INSURANCE: Provided the client is licenced to drive, all fees include client cover whilst driving the training vehicle. Clients must be accompanied by either a DVSA Approved Driving Instructor, or an approved DVSA Examiner. FITNESS TO DRIVE: In accordance with the Drug Driving laws, March 2015, prior to commencing a lesson you, the client, must advise your instructor of any medical condition you may have, or ANY substance you have taken which could impair your ability to drive. Your instructor will ask you to confirm your continued fitness to drive at the start of each lesson and record your answer. Where there is any doubt, either on the part of the client or the instructor, “FDT” reserves the right to cancel the lesson. Similarly, where there is an obvious and clear impairment, for example in the case of alcohol, the lesson will not be permitted to go ahead. Where ANY doubt exists regarding your fitness to drive, consult your doctor. Further details can be found at https://www.gov.uk/drug-driving-law Where doubt exists concerning an individual’s fitness to drive, which results in the cancellation of the lesson, the full lesson fee remains payable. CANCELLATION POLICY: Where a lesson needs to be cancelled by the client, irrespective of the reason, 48 hours notice is required. Where cancellations are received with less than 48 hours notice, the full lesson fee will remain payable. Where lessons have been pre-paid and the required cancellation notice is not given, the lesson fee will be forfeited. Where short notice cancellations become routine “FDT” reserves the right to withdraw service without notice. Exceptions are entirely at the discretion of your instructor. Where your instructor has to cancel a lesson, for any reason, and 48 hours notice is not given, your next lesson will be provided free of charge.   FEES: Details of current tuition fees and driving test day fees can be found on the Prices page of our website. See also “Driving Test” below. PAYMENTS: Payment is accepted either by cash or electronic bank transfer. No cheques, debit or credit cards. If payment is by cash, the lesson fee is to be paid in full at the start of the lesson. If the client needs to use a cash dispenser, they must make this known at the start of the lesson, and this will form part of the lesson time. If payment is by internet transfer, the full amount is to be transferred 24 hours prior to the lesson. WHERE THE LESSON FEE IS NOT RECEIVED IN ACCORDANCE WITH THE ABOVE TERMS, “FDT” RESERVES THE RIGHT TO CANCEL THE LESSON. “FDT” does not provide credit facilities to anybody, for any reason, under any circumstances. Where a client pre-pays for a block of 10 hours, if, for any reason whatsoever, the client wishes to cease lessons, the remaining balance will be refunded in full upon receipt of 48 hours written notice of cancellation. APPOINTMENTS: While every care will be taken to ensure clients receive training at the requested time, all bookings are made on the understanding that “FDT” is not responsible for the postponement of training due to traffic conditions, adverse weather, mechanical breakdown, illness or any other cause beyond our control. If, in the view of the Instructor, a pupil is unfit to carry out a lesson safely, due to self- induced circumstances e.g. alcohol or drugs, the lesson fee remains payable and the lesson will not be permitted to go ahead. TRAINING AIDS: All question papers, hand-outs, books, C.D. ROMs and relevant materials remain the property of “FDT”. If not returned on request a replacement fee will be charged. Driving courses / lessons may involve working breaks away from the tuition vehicle, to discuss progress, look at lesson plans etc. THE DRIVING TEST: “FDT” reserves the right to withhold use of the training vehicle if, in the Instructors opinion, the client has not reached the required standard. “FDT” charges the following rates for Test Day. This does NOT include your DVSA booking fee: Isleworth / Ashford - £70 This fee includes a one hour lesson prior to your test, use of the tuition vehicle for the duration of your test, debrief and return travel to the original pick up point. Any additional lesson time required prior to the test, over and above the inclusive hour, will be charged at the prevailing standard hourly rate (see website for current prices). Your DVSA test fee is payable separately when booking your test online. “FDT” test day fees are payable in cash prior to the start of your test, or online 24 hours prior to your test. “FDT” cannot be held responsible for Test Appointments being postponed or cancelled by the DVSA for any reason. If your test is cancelled at short notice by the DVSA, the test day fee is still payable to “FDT”. In these circumstances, you must reclaim this from the DVSA directly. Furthermore “FDT” is not responsible for any failure of light bulbs etc. during the Practical Test.  All bulbs / lights etc. will be checked with the candidate prior to commencement of the test. “FDT” cannot be held responsible in the event of mechanical breakdown prior to, or on the day of a driving test. Such circumstances cannot be foreseen, however, “FDT” will make every effort to obtain a replacement vehicle. If unable to do so, “FDT” will refund the cost of the DVSA Practical Test fee only. Where a client is advised of any mechanical failure, and there is sufficient time to cancel / reschedule the test to avoid  financial loss, but the client chooses not to do so, “FDT” will not refund the DVSA Practical Test Fee in these circumstances. PERSONAL ITEMS: “FDT” will not accept responsibility for damage or marking to clothing as a result of coming into contact with areas of the vehicle subjected to road dirt, brake dust, mechanical oils or grease - including the Show Me, Tell Me section of the course or Practical Test. This may involve lifting the bonnet for which disposable gloves are provided if required. “FDT” accepts no liability for personal property that is left in the training vehicle or lost at any point during the course of a lesson. LINKS TO THIRD PARTY WEBSITES: This website may include links to third party websites that are controlled and maintained by others.  Any link to other websites is not an endorsement of those websites and “FDT” is not responsible for the content or availability of any such sites. MOBILE COMMUNICATIONS: All clients should ensure that mobile phones are switched off, prior to entering the training vehicle. For the safety and comfort of all occupants in the training vehicle, no calls will be permitted while the vehicle is in motion. SPECIAL OFFERS: Special Offers are provided entirely at the discretion of “FDT” and can be changed or withdrawn at any time and without prior notice. “FDT” reserves the right to withdraw any special offer terms where tuition fees remain unpaid. Any special offer is to be used within 30 days of commencing your driving course, otherwise it is forfeited and the prevailing standard hourly rate will apply. If a client switches to “pay as you go” on expiry of a block booking discount, the standard hourly rate will apply. Introductory reduced price hours are to be taken in blocks of 2 hours. For example, an offer of first 4 hours at a reduced rate must be taken in 2 blocks of 2 hours, and within 30 days of commencing training. DATA PROTECTION: To satisfy HMRC requirements, information regarding all payments to “FDT” must be held for not less than 7 years, after which time such information, whether paper or electronic will be permanently destroyed. For training purposes, and also for the safety and protection of the occupants of the training vehicle, front and rear facing CCTV cameras are fitted. Whilst the cameras record both video and sound, there is no internal view of the vehicle or it’s occupants. The memory cards which record the footage are erased at the end of each day. In the event of an incident, and if requested, video footage would be released to Police or insurance companies to assist in establishing liability. Under current Driving Test rules, video recording of a driving test is not permitted, so all camera equipment is removed from the training car before the commencement of a Practical Test. Video equipment will remain operational unless the client makes their objections known prior to commencement of a lesson. Revised August 2017
